What Is Considered Domestic Violence In North Carolina?

Under North Carolina Law (N.C.G.S. 50B-1), domestic violence occurs when a person with whom you have a personal relationship does any of the following:

  • Causes or attempts to cause bodily injury.

  • Places you or a family member in fear of imminent serious bodily injury or continued harassment.

  • Commits acts of sexual assault.

  • Threatens you with physical harm or emotional distress.

A "personal relationship" can include:

​

  • Current or former spouses

  • Persons of the opposite sex who live together or have lived together

  • Parents and children

  • Persons who have a child in common

  • Current or former dating partners

Obtaining a Domestic Violence Protective Order (DVPO)

If you are the victim of domestic violence, you may petition the court for a Domestic Violence Protective Order (DVPO)--also known as a 50B Order.

A DVPO can provide immediate legal protection, including:

​

  • Prohibiting the abuser from contacting you or your children.

  • Granting temporary custody of children.

  • Ordering the abuser to move out of a shared residence.

  • Awarding temporary possession of personal property. 

  • Prohibiting the abuser from possessing a firearm.

​

There are two types of protective orders: 

​

  1. Ex Parte (Emergency) Order:  Granted temporarily without the abuser present if the court believes there is an immediate threat.

  2. Permanent DVPO:  Issued after a court hearing where both parties may present evidence. This order can last up to one year and be extended upon filing the appropriate motions.
